Are you looking for a Psychiatric Assessment for Legal Proceedings?

Important information before you book your appointment

At Talkmind we provide online psychiatric consultations for diagnostic and treatment purposes. However, we have noticed we occasionally receive requests from patients seeking assessments for use in court /legal proceedings. If this applies to you, please read the following carefully before booking.

Understanding the Difference: Clinical vs. Legal Assessments:

1. Treating Psychiatrist (Clinical Assessment)

Yes

  • Purpose: To assess and provide treatment recommendations for your mental health.
  • Outcome: Clinical notes and standard medical documentation.

No

  • The clinical assessments, consultation notes and clinic letters would not be compliant with Criminal Procedure Rules and thus, cannot be served as a substitute for an independent expert witness report.

2. Expert Witness Psychiatrist (Legal Assessment)

  • Purpose: To provide a formal psychiatric evaluation specifically for legal purposes.
  • Outcome: A legally structured expert witness report that courts can use as evidence.
  • Requires: A detailed [forensic] assessment and impartial opinion.

Why This Matters?

If you need an assessment for a legal case, a clinical appointment will not meet the required legal standards.
Clinical notes from a standard assessment may be dismissed in court and not serve your intended purpose.

What Should You Do?

If You Are Representing Yourself (No Legal Advisor) then consider consulting a legal expert to guide you on the right type of psychiatric assessment needed.
If you require a court-admissible report, you need to book an expert witness assessment, not a clinical consultation.

If You Still Need a Clinical Assessment

Book only if your primary goal is treatment and medical advice, not a legal report.
Where appropriate, our psychiatrists will clarify these distinctions during the session. If you decide not to proceed, you will not be eligible for a refund. Please ensure you are booking the correct service before proceeding.
For further guidance, please contact our administration team before booking.
